Welcome to https://www.elanvitalsurf.com (the “Website”). These Terms and Conditions govern your use of the Website and all purchases of surf gear, apparel, accessories, and related products (“Products”) from Elan Vital Surf & Sport (“we,” “us,” “our”).
By placing an order or using the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website or place an order.
1. Ordering & Contract Formation
- All orders are subject to acceptance and availability.
- A binding contract is formed only when we send you an order confirmation email.
- We reserve the right to refuse or cancel any order for any reason (e.g., product unavailability, pricing error, suspected fraud).
2. Prices & Payment
- Prices are shown in USD and include sales tax only where required by law.
- We accept WooCommerce Payments, PayPal, Apple Pay, Google Pay, and major credit/debit cards.
- Payment is taken at the time of order. We never store full card details.
3. Shipping & Delivery
- Shipping costs and estimated delivery times are displayed at checkout.
- Risk of loss and title pass to you upon delivery to the shipping carrier.
- We are not responsible for delays caused by carriers or customs.
4. Returns & Refunds
- You have 30 days from delivery to return unused, undamaged items with tags attached.
- Sale items, wetsuits (for hygiene reasons), and custom/cut-to-length items are final sale.
- Return shipping is paid by the customer unless the item is faulty or we sent the wrong product.
- Refunds are issued to the original payment method within 7 business days of receiving the return.
5. Warranty & Repairs
- All Products come with a 12-month manufacturer’s warranty against defects in materials and workmanship.
- We offer lifetime repairs on flagship items (reasonable wear and tear excluded) at cost of parts + shipping.
- Damage from normal use, accidents, or improper care is not covered.
6. Intellectual Property
All content on the Website (photos, text, logos, designs) is owned by Elan Vital Surf & Sport or its licensors and is protected by copyright and trademark laws. You may not use it without written permission.
7. Limitation of Liability
To the fullest extent permitted by law:
- Products are sold “as is” for recreational use only.
- We are not liable for indirect, incidental, or consequential damages.
- Our total liability shall not exceed the purchase price of the Product in question.
8. Environmental Commitment
For every purchase, we donate a percentage to ocean sustainability programs. This is funded automatically—no action required from you.
9. Governing Law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles. Any dispute will be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida.
10. Changes to Terms
We may update these Terms at any time. The latest version is posted here with the “Last updated” date. Continued use of the Website after changes constitutes acceptance.
